Shortly thereafter, she received an extremely negative performance appraisal which she protested and the appraisal was rescinded. Approximately a year later, she received another negative appraisal from another employee (lower ranking than the original employee who reported the violation) but to whom authority to perform the appraisal had been delegated by the original supervisor. The second performance appraisal was widely circulated among other employees through social media in violation of company policy. The employee resigned and filed suit for retaliation for whistle blowing and libel. The employer responded that the employee resigned voluntarily. Does the employee have a case for constructive discharge?
