Before our discussion in future weeks about various protections in the Bill of Rights and 14th Amendment we need to make sure everyone understands the role of the US Constitution and the States.
For your forum discussion this week discuss:
1) What is the state action doctrine?
2) Find a news article and share it where someone is alleging the violation of their Constitution Rights. Apply the state action doctrine to their allegations. Does the state action doctrine apply? Could these individuals have valid complaints about the violation of Constitutional Rights?
State Action Doctrine
The constitution has always been the primary basis of any legal action undertaken by individuals or states. Consequently, it holds significant power of control over different entities and circumstances, based on which individuals and states could seek prosecution if anyone individual or state went against the tenets of the constitution. However, a source of such power needed to be regulated accordingly to prevent cases of abuse where people or entities used the constitutions to bar others from otherwise exercising their freedoms. In essence, without such control of the application of the constitution, then it would be impossible to implement such rights as liberty of association. Consequently, the state action doctrine, in the Fourteenth
